2. Your Account & Responsibilities

3. Products & Services Description
We specialize in curated botanical products with the following characteristics:
- Live Plants: Including Bright Indirect Light Houseplants, Full Sun Houseplants, Cacti & Succulents, Hanging & Trailing Plants. Each is nurtured with care, but natural variations in size, color, and leaf pattern are part of their unique beauty.
- Art & Decor: Our Botanical Art Prints, Posters & Stickers are created by artists. Slight color variations may occur between your screen and the printed product.
- Care & Gardening Supplies: From Essential Plant Care Supplies and Grow Lights to Gardening Hand Tools. We select items for their quality and functionality.
- Specialty Items: Dried Floral Bouquets | Everlasting Beauty are artfully preserved and delicate. Bargain Gifts – Sale Items are offered as-is at discounted prices.
We strive for accurate descriptions and photography, but if you receive a product significantly not as described, please contact us immediately.
4. Orders, Pricing, & Payment Terms
Order Acceptance
Your order is an offer to purchase. Acceptance occurs when we send an order confirmation email. We reserve the right to refuse or cancel any order for reasons including stock availability, pricing errors, or suspected fraud.
Pricing
Prices are listed in US Dollars. We may update prices at any time, but changes will not affect confirmed orders. Prices do not include applicable taxes or duties, which are the customer’s responsibility.
Payment Methods
We accept payments via Visa, MasterCard, JCB, and PayPal. Payment is processed securely at checkout. Your card will be charged when the order is placed.
Shipping & Delivery
Processing: Orders are processed within 1–2 business days (excluding weekends/holidays).
Methods:
– Standard Shipping ($12.95): Via DHL or FedEx. Estimated delivery 10–15 business days after dispatch.
– Free Shipping: For orders over $50 via EMS. Estimated delivery 15–25 business days after dispatch.
Delivery Area: We ship globally but cannot ship to parts of Asia and some remote areas due to customs restrictions. Delivery times are estimates and subject to delays from customs, weather, or carriers.
Live Plant Care: Plants are shipped with care instructions and may include heat packs in cold weather to ensure vitality. You are responsible for checking and caring for the plant upon receipt.
5. Returns, Exchanges & Refunds
Our policy is designed to be fair and transparent, rooted in our commitment to your satisfaction.
Eligibility
- Timeframe: You have 15 calendar days from the delivery date to initiate a return or exchange.
- Condition: Items must be in original, unused, resalable condition with all packaging. Plants must be alive and healthy upon return.
Process
- Initiate Request: Email [email protected] within the 15-day window.
- Receive RMA: We will provide a Return Merchandise Authorization (RMA) number and instructions. Do not ship without an RMA.
- Ship Back: Pack items securely in original packaging, include the RMA/order copy, and ship to our Chicago facility using a trackable method. You are responsible for return shipping costs and the item until it reaches us.
- Inspection & Resolution: We inspect returns within ~5 business days. For approved requests, we will process a refund or exchange.
Important Exceptions (Final Sale Items)
The following items are non-returnable and non-exchangeable unless they arrive damaged or dead (report within 48 hours with photos):
- Dried Floral Bouquets | Everlasting Beauty
- Bargain Gifts – Sale Items (all clearance section items)
- Custom or Personalized Items (e.g., Corporate Plant Gifts & Services, personalized art)
- Digital Downloads (e.g., digital Botanical Art Prints)
- Used or Opened Plant Care Supplies (soil, tools, liquids)
- Gift Cards
Refunds
For approved returns:
– Processing: 5–10 business days after approval.
– Method: Issued to the original payment method.
– Shipping Costs: Original shipping fees are non-refundable unless the return is due to our error. For exchanges, we cover standard shipping for the replacement.
6. Intellectual Property
All content on this site—including text, graphics, logos, images, artwork (such as our Botanical Art Prints designs), and software—is the property of Eds Plant Shop or our licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission. Purchasing a physical art print or product does not transfer its copyright to you.
7. Limitation of Liability
Our commitment is to provide the highest quality products and service. However, to the fullest extent permitted by law:
- Eds Plant Shop shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site or any products purchased, including but not limited to loss of profits, data, or loss of a plant due to conditions after delivery and beyond our control.
- Our total liability for any claim related to your order shall not exceed the purchase price of the product(s) in question.
- We are not responsible for delays or failures in performance due to circumstances beyond our reasonable control (force majeure), including natural disasters, pandemics, war, or supply chain disruptions.
This limitation does not affect any statutory rights you may have as a consumer.
8. Governing Law & Changes
These Terms are governed by the laws of the State of Illinois, United States. Any disputes shall be resolved in the courts located in Cook County, Illinois.
We may update these Terms and Conditions periodically. The latest version will always be posted on this page with an updated “Last Updated” date. Continued use of the site after changes constitutes acceptance of the new terms.
